Terms and Conditions of Use

This page states the "Terms of Use" under which you may use the AFL-CIO Resume Posting Service for Strategic Campaigners (“RPSSC”), an on-line service to post and search employment opportunities and user resumes. These Terms of Use include the AFL-CIO Privacy Policy, which is incorporated into these Terms of Use by reference. By using the RPSSC, you are indicating your agreement to these Terms of Use, including the AFL-CIO Privacy Policy. By using the RPSSC, you are indicating your acceptance to be bound by the provisions of these Terms of Use. If you do not accept the Terms of Use stated here, do not use the RRP site. The AFL-CIO may revise these Terms of Use at any time by updating this posting. You should visit this page periodically to review the Terms of Use, because they are binding on you. The terms "you" and "User" as used herein refer to all individuals and/or entities accessing the RPSSC web site for any reason.

1. Eligibility.
You must be 18 years of age or older to visit or use the RPSSC in any manner. By visiting the RPSSC or accepting these Terms of Use, you represent and warrant to the AFL-CIO that you are 18 years of age or older, and that you have the right, authority and capacity to agree to and abide by these Terms of Use. You also represent and warrant to the AFL-CIO that you will use RPSSC in a manner consistent with any and all applicable laws and regulations.

2. Use of RPSSC Content.
The AFL-CIO authorizes Users seeking employment to submit Content; the AFL-CIO authorizes approved Employer Users to view and access a single copy of the content available on or from RPSSC. The contents of RPSSC are protected under both United States and foreign copyright, trademark and other laws. All RPSSC Content is the property of the AFL-CIO or its site suppliers. The compilation (meaning the collection, arrangement and assembly) of all content on the RPSSC site is the exclusive property of the AFL-CIO and protected by U.S. and international copyright laws. Unauthorized use of RPSSC content may violate copyright, trademark, and other laws. You may not sell or modify RPSSC content or reproduce, display, publicly perform, distribute, or otherwise use RPSSC content in any way for any public or commercial purpose.

3. RPSSC Site Restrictions.
Users may not use RPSSC in order to transmit, distribute, store or destroy material, including without limitation, RPSSC content (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful.
Users are also prohibited from violating or attempting to violate the security of the RPSSC site, including, without limitation, the following activities: (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; or, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to any AFL-CIO Site, overloading, "flooding", "spamming", "mailbombing" or "crashing". Violations of system or network security may result in civil or criminal liability. The AFL-CIO will investigate occurrences which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

4. Specific Prohibited Uses.
The job posting and resume database features of RPSSC may be used only for lawful purposes by individuals seeking employment and employers seeking employees.
The AFL-CIO specifically prohibits any other use of RPSSC, and all Users agree not to do any of the following: (a) post jobs or content that contain any hyperlinks, "hidden" keywords or any keywords that are irrelevant to the job or are otherwise misleading; (b) use any RPSSC Resume Database for any purpose other than as a User seeking employment or as an employer seeking employees; (c) post or submit any incomplete, false or inaccurate biographical information or information which is not your own; Content you submit must describe you, an individual person; (d) delete or revise any material posted by any other person or entity; or (e) take any action that imposes an unreasonable or disproportionately large load on any AFL-CIO site infrastructure.

5. User Content and Submissions.
You acknowledge and agree that you are solely responsible for the information and content, including its form and accuracy, that you submit, publish or display (hereinafter, "post") on RPSSC. The AFL-CIO makes no representations about the accuracy, reliability, completeness or timeliness of any Content.
The AFL-CIO is not to be considered to be an employer with respect to your use of the RPSSC site and the AFL-CIO shall not be responsible for any employment decisions, for whatever reason made, unless made directly by the AFL-CIO.
By posting Content to RPSSC, you automatically grant, and you represent and warrant that you have the right to grant, to the AFL-CIO an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, display, and distribute such User Content.
The AFL-CIO acts as a passive conduit for the online distribution and publication of User Content and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring User Content posted by Users. However, the AFL-CIO may review and delete any User Content that, in its the sole judgment, violates these Terms of Use; violates applicable law, rule or regulation; is offensive or promotes or endorses racism, bigotry, hatred or harm of any kind against any group or individual; is illegal or violates the rights of, harms or threatens the safety of Users of the RPSSC or the AFL-CIO website; or is abusive, threatening, obscene, defamatory, disruptive or libelous. The AFL-CIO reserves the right to expel Users and prevent their further access for violating the Terms of Use or applicable law, rule or regulation and the right to remove User Content which is in violation of the Terms of Use.
The AFL-CIO reserves the right in its sole discretion to investigate and take legal action against anyone who engages in any illegal or prohibited conduct or otherwise violates these Terms of Use, including without limitation, removing the User Content, terminating the offending User's ability to access RPSSC. The AFL-CIO may take any other action with respect to User Content or User actions that it deems necessary or appropriate in its sole discretion.
The AFL-CIO does not represent or guarantee the truthfulness, accuracy, or reliability of User Content. The AFL-CIO does not independently verify the information provided by candidates or the identity of candidates and has no obligation to do so. You acknowledge that any reliance on material posted by other Users will be at your own risk.

6. Registration and Password
Users seeking employment:
Users seeking employment can access the public site, which includes a landing page, Frequently Asked Questions, a resume submission form, and the Terms of Use, including the AFL-CIO Privacy Policy.
Employer Users:
In order to search the resume database of RPSSC, Employer Users must submit a registration request and be approved for access to an AFL-CIO site which houses the resume database. In order to be approved for access, Employer Users must be a research director, research hiring manager or similarly situated designee of an AFL-CIO affiliated union who has registered for and been granted access. Those granted access will be provided with an activated user name and password which will allow access to the resume database of Content submitted by Users seeking employment. Access approval will be given by the AFL-CIO RPSSC Administrator or other designee, is subject to the sole discretion of the AFL-CIO RPSSC Administrator or other designee, and may be terminated at any time. Employer Users whose access has been terminated will be notified via e-mail.

7. The AFL-CIO’s Liability.
The AFL-CIO is not involved in the actual transaction between employers and candidates. As a result, the AFL-CIO has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings, or any User Content, and makes no representations about any jobs, resumes or User Content.

8. Disclaimer of Warranty.
The AFL-CIO does not warrant that RPSSC will operate error-free or that its servers are free of computer viruses or other harmful mechanisms. If your use of the RPSSC website or its Content results in the need for servicing or replacing equipment or data, the AFL-CIO is not responsible for those costs. In no event shall the AFL-CIO be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the RPSSC site and Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not the AFL-CIO is advised of the possibility of such damages. The AFL-CIO, RPSSC and its Content are provided on an “as is” basis without any warranties or any kind. The AFL-CIO, to the fullest extent permitted by law, disclaims all warranties, whether express or implied, including the warranty of merchantability, fitness for particular purpose, and on-infringement. The AFL-CIO makes no warranties about the accuracy, reliability, completeness, or timeliness of RPSSC Content, services, software, text, graphics, and links.

9. Indemnity.
You agree to defend, indemnify, and hold harmless the AFL-CIO, its officers, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) any User Content or other material You provide to the RPSSC Site, (ii) your use of any RPSSC Content, or (iii) your breach of the terms of these Terms of Use. The AFL-CIO shall provide notice to You promptly of any such claim, suit, or proceeding.
